Liability Insurance Update

important update to your Public Liability Insurance

Previously, your renewal schedule included a participation exclusion that limited cover for certain activities. Your insurer, CGU, has now updated this to better reflect their intention-specifically around excluding only high-risk activities.

 

What’s changed?

The exclusion that was originally included on your Membership renewal tax invoice and listed as  ‘Participation exclusion without recreational activity’. CGU have removed this effective 1/8/25 and it has now been replaced with the following endorsement;

“Participation Endorsement
This Policy does not cover any liability for Personal Injury arising out of or in connection with the participation by any person in any:

  • Dangerous Recreational Activity; or
  • Any athletic or sporting activity, training, competition, demonstration, performance, trial or race; or
  • Inflatable play structures i.e. Jumping Castles

However, this Exclusion does not apply to:  

  1. Personal Injury to a spectator; or
  2. walking, hiking, dancing; or
  3. Fun runs, relays, egg and spoon races, 3 legged races; or
  4. lawn bowls, ping pong, table tennis; or
  5. colour runs provided Holi powder is sourced exclusively from an Australian supplier.
  6. jumping castles where, for the entire period of use, continuous supervision is provided by a competent person engaged and supplied by the owner or supplier of the device,  or by a third party appointed by them, and who is neither the insured nor acting on behalf of the insured.
  7. any activity approved in writing by CGU”

For the purpose of this exclusion Dangerous Recreational Activity means a recreational activity that involves a significant risk of physical harm to the person participating in that activity.  

Information on the definition of Dangerous recreational activities can be found in the Civil Liability Act 2002.”

 

Impacts to your P&C Event Planning

From a planning and process point of view, there is NO change to how you should organise your events.

  1. Submit a Notice of Events (NOE) form, available on the P&C Federation website, or via link here: www.pandc.org.au/associations/noe
  2. Once submitted, we’ll review your activity and respond with approval or ask for more details if needed
  3. For larger events (ie, involving third parties or multiple activities), submit a Risk Assessment

 

Changes to your Events/P&C Association

As part of your insurance, your P&C has a legal responsibility under the Insurance Contracts Act called the Duty of Disclosure. This means you must let us know about anything that could affect your insurance, not just when the policy starts but at any time during the policy period.
This includes;

  • New or different activities your P&C is undertaking
  • Changes to how you’re running events
  • Unusual or higher risk activities (e.g. involving amusement rides or third-party providers)

Anything else that might impact CGU’s acceptance or ability to Insure your event.

It’s important to remember that this update specifically relates to Personal Injury arising from physical participation. This policy is not intended to cover high risk activities where there is a significant risk of harm. It’s designed to support & protect the P&C’s general fundraising & community activities.
