Is your P&C Association under Fair Trading?
If your P&C Association is under a Fair Trading Constitution, there have been important changes to the Associations Incorporation Act 2009 due to the COVID-19 pandemic.
Your P&C Association can now hold a meeting at multiple venues using technology (such as audiovisual link software) that gives a reasonable opportunity for participation in the meeting. The amendment also allows voting on resolutions by the members of an association to be conducted by postal or electronic ballot.
Crucially, this now applies even if your constitution does not specifically provide for online meetings.
You can read the amendment at this link, under Part 6 Meetings and voting during COVID-19 pandemic
Please note this applies only to P&C Associations incorporated under Fair Trading. If you are incorporated via P&C Federation or are not incorporated at all, this does not apply. If you are unsure, feel free to contact P&C Federation on 1300 885 982.
